These terms and conditions (the “Terms and Conditions”) govern your relationship with https://ponnti.com website (the „Website“) operated by PONNTI GROUP, s.r.o. (Reg. No. 52102386) (“PONNTI” or “us” or “we”or „our“) and apply to all use of and orders placed through PONNTI GROUP website www.ponnti.com (the “Website”), and to all orders made by telephone or an e-mail . PONNTI GROUP reserves the right to revise the Terms and Conditions at any time. Each purchase is subject to the Terms and Conditions in the version applicable at the date of submitting the order. You should keep a copy of these Terms and Conditions for future reference.
Please read these Terms and Conditions carefully before using the Website.
Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Website.
By accessing or using the Website you agree to be bound by these Terms and Conditions. If you disagree with any part of the Terms and Conditions you may not Access the Website.

 

PLACING AN ORDER.

By using the Website and/or placing an order on the Website, by telephone or an e-mail , confirm that you have read and that you accept these Terms and Conditions and our Privacy Policy. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order. Please note that products in your shopping bag may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of products may be lost. In such case, you will be required to re-enter your selection of products to the shopping bag.

 

ORDER CONFIRMATION.

After submitting your order, we will send you an e-mail with your order number, details of the product or products you have ordered, your payment details and delivery details. Please note that such e-mail is an acknowledgement that we have received your order, not an acceptance of it.
Once the order has been processed, an order confirmation e-mail the “Order Confirmation” will be sent to you. The Order Confirmation is our acceptance of your order.
Please note that all orders are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. If we have received payment for a rejected order already, we will refund you the amount of the purchase.
PONNTI does not guarantee that all products displayed on the Website are in stock at the time of acceptance of your order. If a product is unavailable, we will contact you in due time, by phone or by e-mail. If we have received payment for such product already, we will refund you the amount of the purchase or if possible, we will contact you and agree on the delivery time.
Refunds shall be made using the same payment method you used for the purchase.

 

COLOURS.

PONNTI´s goal is to describe the products on the Website as correctly as possible. However, please note that every pair of PONNTI´s shoes is handmade and every pair is unique when it comes to a colour and leather used to produce them. Olso due to the colour settings of your computer, phone as well as light reflections during photoshoots, the colours of the products shown in the pictures on the Website can differ somewhat from their actual colours. PONNTI cannot be held responsible for any such discrepancy.

 

PRICES.

The prices and delivery costs shown on the Website include VAT for the jurisdictions where it applies. The prices shown on the Website may vary from time to time and PONNTI is not bound by the price until the order has been accepted by us and you have received our Order Confirmation. If you have placed an order and the price has changed before we have accepted your order, we will notify you by e-mail about the price change and give you the option to confirm your order with the new price or cancel the order. If we are unable to contact you, your order will be cancelled. Please also note that we may not accept an order or revoke the acceptance of any order under the condition that you realise or should have realised that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.

 

PAYMENTS.

The following payments methods are accepted: Visa, Visa Debit, AMEX, AMEX Debit, MasterCard, MasterCard Debit and PayPal.
Purchases paid with Visa and Mastercard are verified by a secure code. Please note that your card is debited with the purchase amount once the order is dispatched. We do our best to make the Website as secure as possible. All credit/debit card transactions on the Website are processed using WebPay and Paypal payment systems, which are both secure online payment gateways that encrypt your card details in secure host environments. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to PONNTI, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.
When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will be redirected to the Website.

 

DELIVERY.

SHIPPING METHODS – We offer different shipping methods to meet your needs, as further specified when you check out. Dispatch of orders may take up to 7 business days but we aim to dispatch all orders within 24 hours during weekdays, or 1-2 business days during sales periods. The delivery times do not take into account possible delays caused by payment authorisation and/or on the part of the shipping company. If PONNTI fails to deliver within 30 days, you have the right to cancel the purchase.
Your order will be delivered by DPD to the shipping address you have indicated when placing your order. Once your order has been dispatched, we will send you an email detailing the courier and the tracking number. You will be able to use this number to track your order.

 

FIRST TIME ORDER POLICY.

For security purposes, PONNTI reserves the right to ship first-time orders to the cardholder’s verified billing address or work address. To avoid delays in receiving your order, please make sure to provide the correct billing and shipping information associated with your credit/debit card when placing an order.

 

RETURNS.

You are entitled to return any product you have purchased from us within 14 days from the day on which you have, or a third person designated by you (other than the carrier) has received, the relevant product, and we will reimburse you all payments we have received from you in connection to the returned product. In order to exercise your right of revocation, you must timely inform us at returns@ponnti.com or +421 905 879 456 (SVK local number) . You may also electronically complete and submit the return form provided on the Website.
The product must be returned in its original conditions, including original packaging.
We are entitled to refuse any returns shipped back to us after the expiration of the above 14 day term. We are also entitled to refuse any return of products that are not returned to us in their original conditions.
Repayments we will be made using the same means of payment that you have used for the initial transaction, unless expressly agreed with you otherwise.

 

EXCHANGES.

Purchased products are exchangeable into a different size with no extra costs, based on stock availability. Purchased products are exchangeable into a different product; in such case, we will charge or refund you any price differences. For such additional charge or repayment, we will use the same means of payment that you have used for the initial transaction unless expressly agreed with you otherwise.

We are entitled to refuse any exchange until we have recovered the product and checked that this is returned in its original conditions, including original packaging.
Please note that sale products and products belonging to the “less than perfect” category are non-exchangeable.

You will be responsible for paying for your own shipping and insurance costs for returning the unwanted or exchanged product. You should consider using a trackable shipping service to ensure the unwanted product is returned safely to us.

 

RETURNING THE PRODUCTS.

Follow the following process : (1) contact our Customer Service team at returns@ponnti.com or +421 905 879 456 (SVK local number) to initiate a return or exchange, (2) place the product and its original packaging in the original shipping box, or any other solid carton box, (3) close the box and tape it securely, (4) send it back to us using a carrier of your choice (international).
It is your responsibility to ensure the products are protected and insured (international) during transit.

 

DEFECTIVE PRODUCTS.

If you receive a defective product, please notify us immediately. You are entitled to complain about defective products within 30 days from delivery. However, you must always notify PONNTI within a reasonable time after you have detected that the product is defective. If PONNTI consider the products to be defective, PONNTI will make a full refund including return costs.

 

DISCOUNT CODES.

Discount codes are not cumulative and do not apply to ‘Before They Go’ items and any other product already discounted.

PONNTI reserves the right to seek all solutions available to us against violations of these Terms and Conditions, including the right to block access to the site.

 

LIABILITY.

Any damage liability of PONNTI. Exempted from this exclusion are claims of the customer related to damages to health, body and mind, or damages resulting from a violation of material contractual obligations (cardinal duties), as well as the liability for other damages which are based on intent or gross negligence of PONNTI and its representatives. Material contractual obligations are obligations which are precondition to the successful performance of the contract and on the observation of which the customer can legitimately rely. In the event of a violation of material contractual obligations, PONNTI’s liability is limited to the foreseeable and typical damage if such damage has been caused slightly negligent, unless a damage to health, body and mind is concerned. The limitations set forth above also apply for the benefit of the representatives of PONNTI if claims are made directly against them. PONNTI assumes no liability in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. In case of force majeure, PONNTI’s obligations will be suspended. The contract between you and PONNTI can, in such cases, be partially or fully terminated by yourself or by PONNTI.

shipping & delivery.

We offer standard delivery on all main destinations. If your destination is not available at check-out please contact us on info@ponnti.com and we will be happy to assist. For selected destinations, at checkout, you can also choose Express Shipping at an extra cost.

 

DUTIES AND TAXES.

Deliveries to European Union are NOT subject to additional taxes and duties. A number of other countries, including Canada, Australia, China and Korea and many others apply duties and taxes which can be significant and are payable by you upon receipt of the parcel, according to the applicable laws in your country. We are working on embedding a tax calculator on our website, but in the meantime, you can get an estimate prices of applicable duties for your country checking an online free calculator. CARRIERS.

Quality and speed of delivery is of paramount importance to us, so we only use premium carriers. Specifically, we partner DPD and UPS on all domestic and international deliveries. You will receive the carrier’s details, as well as your tracking number, with the email confirming your order.

 

TRANSIT TIMES.

Orders are typically processed and dispatched within 1-2 business days. When your order leaves our warehouse we will send you an email together with your tracking number and shipping details.
From our email about leaving your order our warehouse, it will take you
from 1 to 6 working days to receive your purchase if you are in the European Union,
4-8 days North America, and up to 10-14 working days if you are in South America, Asia, Africa and Oceania. The estimate transit times are detailed during the check out process based on your specific country.

 

RETURNS AND EXCHANGES

You are entitled to return any product you have purchased from us within 14 days from the day on which you have, or a third person designated by you (other than the carrier) has received, the relevant product, and we will reimburse you all payments we have received from you in connection to the returned product.
Products must be returned in their original packaging.
We recommend that you check if your shoes fit to your satisfaction on a carpet before wearing them outside or on rough surfaces as all returned goods need to be in perfect condition. Unfortunately if the shoes have been worn outdoors or are otherwise damaged, the product is not eligible for return.

RETURNS AND EXCHANGES

For all destinations, please contact us via email at returns@ponnti.com before you return the product to communicate your intention to return or exchange the product. You will be responsible for paying for your own shipping costs for returning your item. You should consider using a trackable shipping service to ensure the unwanted items are returned safely. Please ensure that the shoe box is adequately protected to avoid damage in transit.

 

REFUNDS.

All returned items will undergo a rigorous quality check. Once your goods are deemed to be in perfect condition, new, unused and with the original packaging, we will send you an email to notify you that we have received your returned item and confirm whether the return is eligible for the relevant refund. If our inspections confirm that the product has been returned in its original conditions (including packaging), then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment. We are only able to refund the card/payment method originally used for the purchase and it may take up to 10 days, from the date of refund, to appear on your statement/in your account – dependent on your card/payment issuer.

 

IMPORTANT.

Please note that we do not refund costs incurred by the customer for custom an duties or for shipping back the item.

All of our shoes are made in Italy, and are labeled applying European sizing. Our sneakers fit true to size; if you usually wear a half size, we suggest buying the next full size down for the best fit. Our shoes and boots run big in size; choose a size smaller than your normal fit. If in doubt please contact our Customer Care team who will be delighted to help.
